Premises liability

Slip & Fall / Trip & Fall
Slip and trip incidents are common occurrences that can result in minor to severe injuries. Often caused by wet floors, uneven surfaces, loose carpets, or cluttered pathways, these incidents can happen anywhere, from homes and offices to public spaces and industrial sites. Preventing these incidents involves maintaining clean and dry floors, ensuring proper signage when surfaces are wet or slippery, fixing any tripping hazards promptly, and promoting awareness among individuals to tread cautiously in potentially hazardous areas.

Product Liability

Product liability refers to the legal responsibility of manufacturers, distributors, and sellers to ensure that their products are free from defects and are safe for consumer use. If a product causes harm due to a design flaw, manufacturing defect, or inadequate instructions, the liable party can be sued for damages. This principle ensures that companies prioritize consumer safety and uphold standards of quality in their offerings. Consequently, consumers are granted a level of protection and assurance when purchasing and using products in the market.

Medical Malpractice

Medical malpractice refers to the negligence of healthcare professionals, where the care provided deviates from accepted standards, leading to patient harm. This can arise from misdiagnoses, surgical errors, incorrect medication doses, neglect, or a failure to diagnose a condition in a timely manner. Victims can pursue legal action to seek compensation for their injuries or losses. Ensuring strict adherence to medical standards and continued professional training is essential to prevent such incidents and maintain trust in the healthcare system.

Premises liability

Elevator Accidents
Elevator accidents, particularly those involving door striking, misleveling, and elevator drops, can pose serious risks to users. Door striking occurs when the doors close unexpectedly, potentially causing injury, while misleveling refers to the elevator stopping at a level different from the floor, creating a tripping hazard. Elevator drops, one of the most dangerous incidents, involve the abrupt descent of the elevator car. These accidents often result from mechanical failures, poor maintenance, or faulty installations and underline the critical need for regular inspections, rigorous safety standards, and prompt repairs to ensure user safety.

Mechanic's Liens

A mechanic’s lien is a legal claim placed on real estate by someone who hasn’t been paid for work performed or materials provided. Common in the construction industry, this lien ensures that contractors, subcontractors, and suppliers have a way to secure payment for their services. If unpaid, the lienholder can seek a forced sale of the property to recover debts. To protect property owners and ensure fair practice, there are specific processes and timelines associated with establishing and enforcing mechanic’s liens.

Auto Accidents

Auto accident law in New York is a complex and intricate legal framework designed to provide recourse and justice for those involved in motor vehicle accidents. New York operates under a “no-fault” insurance system, which means that injured parties can typically seek compensation for medical expenses and lost wages from their own insurance companies, regardless of who was at fault for the accident. However, when injuries are severe or meet certain criteria, individuals may pursue a personal injury claim against the responsible party. The state also observes a comparative negligence system, allowing compensation to be reduced proportionally if the injured party is found partially at fault.

Construction Accident

Construction accidents encompass mishaps that occur within building and infrastructure project sites. Given the nature of construction work, these incidents can result from falls, equipment malfunctions, electrocutions, or exposure to hazardous materials. The ramifications can range from minor injuries to fatalities. Ensuring rigorous safety protocols, regular training, and the use of protective equipment is pivotal to minimize these risks and protect workers in what is inherently a high-risk environment.

Contract Law

Contract law governs the formation, interpretation, and enforcement of agreements between parties. Central to civil and business relations, it ensures that parties honor their promises, providing remedies in cases of breach. Elements such as offer, acceptance, and consideration are vital for a contract’s validity. Whether written or oral, contracts bind parties to specified terms, and any deviations can lead to legal repercussions. Through contract law, the legal system offers a structured framework that fosters trust and predictability in personal and commercial interactions.

Cycling and Pedestrian Accidents

Cycling and pedestrian accidents occur when bicyclists or individuals on foot are involved in unintended collisions, often with motor vehicles. Such incidents can result from factors like distracted driving, unclear road markings, or a lack of dedicated paths for cyclists and walkers. Given the vulnerability of these groups compared to motorized vehicles, the injuries sustained can be severe. Promoting safer infrastructure, awareness campaigns, and shared road etiquette can significantly reduce these accidents.
